O partido alegava que o cumprimento de decis\u00f5es judiciais n\u00e3o deve se sobrepor aos direitos fundamentais do cidad\u00e3o.<\/p><p>Em seu voto, o relator da a\u00e7\u00e3o, ministro Luiz Fuz, argumentou que as medidas previstas no artigo n\u00e3o significam \u201cexcessiva discricionariedade judicial\u201d. Segundo o ministro, ao aplicar as medidas, o juiz deve observar a proporcionalidade e executar de forma menos grave ao infrator. J\u00e1 o ministro Edson Fachin divergiu em parte do voto do relator, em raz\u00e3o de a legisla\u00e7\u00e3o permitir a aplica\u00e7\u00e3o das medidas no caso de a\u00e7\u00e3o envolvendo pagamento de d\u00edvidas.
